(GENERAL TERMS AND CONDITIONS OF BUSINESS)

1. Scope
These General Terms and Conditions (GTC) apply to all deliveries of freestyle skateboards to consumers (Section 13 of the German Civil Code).
A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either his or her commercial or independent professional activity.
2. Contracting party

3. Offer and conclusion of contract:
3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order. Errors and omissions excepted.
3.2 By clicking the button "order with payment" you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.
4. Right of withdrawal:
4.1 Consumers have the following right of withdrawal
Right of cancellation
You can revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter, fax, email) or - if the item is given to you before the deadline - by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfillment of our information obligations in accordance with Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB and our obligations in accordance with § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To comply with the cancellation period, it is sufficient to send the cancellation or the item in good time. The cancellation must be sent to:

Consequences of revocation:
In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return or surrender the service received and benefits (e.g. benefits of use) to us, or only partially or in a deteriorated condition, you must pay us compensation for the value. You only have to pay us compensation for the deterioration of the item and for benefits derived if the use or deterioration is due to handling of the item that goes beyond checking its properties and functionality. “Checking the properties and functionality” means testing and trying out the respective goods, as is possible and usual in a store. Items that can be sent by parcel must be returned at our risk. You must bear the regular costs of return if the goods delivered correspond to those ordered and if the price of the item to be returned does not exceed 40 euros or if, in the case of a higher price of the item, you have not yet paid the consideration or a contractually agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you. Items that cannot be sent by parcel will be picked up from you. Obligations to refund payments must be fulfilled within 30 days. For you, the period begins when you send your cancellation notice or the item, and for us when we receive it.
End of revocation
The right of withdrawal does not apply to goods that have been manufactured according to customer specifications or are clearly tailored to personal needs.
4.2 Return costs when exercising the right of withdrawal
If you exercise your legal right of cancellation (see cancellation policy), you will have to bear the regular costs of return if the goods delivered correspond to the goods ordered and if the price of the item to be returned does not exceed 40 euros or if, in the case of a higher price of the item, you have not yet paid the consideration or a contractually agreed partial payment at the time of cancellation. Otherwise, the return is free of charge for you.
5. Prices and shipping costs:
5.1 The prices stated on the product pages include statutory VAT and other price components.
5.2 Marshall-Skateboarding is entitled to carry out the order by making partial deliveries. This will not incur any additional costs for you.
Within Germany, delivery is free of charge for orders over EUR 50.00. Shipping costs for orders under EUR 50.00 are EUR 4.00 within Germany. We ship with DHL - transport insurance.
For your information: DHL transport insurance costs EUR 4.99 - EUR 6.99. Our customers within Germany pay EUR 4.00 shipping costs up to EUR 50.00.
Sorry, no more cash on delivery. This costs us 8.00 EUR in shipping costs for each canceled shipment (package is returned).
Shipping costs within the EU with DHL start at €10.00. We only send packages within the EU.
6. Delivery:
6.1 Delivery is made by DHL. (transport insurance).

7. Payment:
Payment can be made via PayPal, credit card, advance payment or direct bank transfer.
8. Warranty:
The statutory warranty provisions apply to defects in the delivered goods. The customer must check the goods for completeness and possible defects immediately upon receipt and report any complaints immediately.
9. Disclaimer:
Freestyle Skateboards' liability is in accordance with statutory provisions. Unless there is gross negligence or intentional breach of duty on the part of Marshall Skateboarding, liability is limited to the average damage that is foreseeable, typical for the contract and usually occurs based on the type of goods.
In particular, it is pointed out that skateboards are sports equipment that can break despite their high quality. Most breakages are due to riding errors or incorrect foot position when landing.
Therefore, Freestyle Skateboards cannot provide a guarantee for broken, cracked or splintered boards. However, if a deck breaks due to lamination, material or processing defects, a replacement will of course be provided. (Such defects can be recognized by the fact that individual layers of wood can be cleanly separated from one another.)
10. Retention of title:
The goods remain the property of Freestyle Skateboards until full payment has been made.
