GENERAL TERMS AND CONDITIONS (GTC)

1. Scope

These General Terms and Conditions apply to all contracts concluded between customers and:

These Terms and Conditions apply in particular to the purchase of skateboards, skateboard accessories, books and other products, as well as to individually agreed services such as skateboard shows, workshops, coaching and appearances.

For consumers, the statutory provisions of German consumer law apply.

2. Conclusion of Contract

The presentation of products and services on this website does not constitute a legally binding offer.

A binding contract is concluded when an order or booking has been accepted and confirmed by Marshall Skateboarding / Guenter Mokulys.

For individually agreed services such as shows, workshops, coaching or appearances, the contract is concluded on the basis of the individual written offer or booking confirmation.

3. Prices

All prices are stated in euros and include the applicable statutory German VAT unless otherwise indicated.

Additional shipping, travel, accommodation or other costs may apply depending on the product or service. Such additional costs will be stated before the contract is concluded.

For shows, workshops, coaching and appearances, the prices and conditions stated in the individual offer or booking confirmation apply.

4. Payment

Depending on the product or agreement, the following payment methods may be available:

For individually agreed services, payment terms are specified in the respective offer or booking confirmation.

5. Shipping and Delivery

Physical products are shipped primarily within Germany.

Shipping costs and available delivery options are shown before the order is completed.

Delivery times depend on product availability and the selected shipping method.

Shipping to other EU countries is currently not generally offered through the online shop.

Books or other products offered through external platforms such as Amazon are subject to the shipping conditions of the respective platform.

6. Retention of Title

Goods remain the property of Marshall Skateboarding until full payment has been received.

7. Right of Withdrawal for Consumers

Consumers generally have a statutory right of withdrawal for distance contracts.

The withdrawal period is generally 14 days from the day on which the customer, or a third party designated by the customer, receives the goods.

To exercise the right of withdrawal, the customer must inform:

by means of a clear statement of the decision to withdraw from the contract.

The statutory provisions regarding withdrawal and return costs apply.

The right of withdrawal may be excluded or restricted in cases provided for by law, for example for individually manufactured or clearly personalised products.

8. Returns

The customer is responsible for ensuring that returned goods are properly packaged.

Statutory consumer rights remain unaffected.

9. Warranty and Liability for Defects

The statutory warranty rights apply.

Skateboards and skateboard components are sporting goods subject to normal wear and tear.

Visible signs of use, scratches, wear on decks, griptape, wheels, trucks, skidplates, tailsavers or other components may occur very quickly during normal skateboarding and do not automatically constitute a defect.

In particular, skateboards may show visible signs of use after only a short period of normal riding.

Warranty claims remain unaffected where an actual material or manufacturing defect exists.

10. Individual and Custom-Made Products

For products made according to customer specifications or clearly personalised for the customer, the statutory right of withdrawal may be excluded in accordance with German law.

The customer will be informed before ordering if this applies to a particular product.

11. Shows, Workshops, Coaching and Appearances

The scope, location, duration, price and other conditions of shows, workshops, coaching sessions and appearances are determined by the individual offer or booking confirmation.

The customer is responsible for ensuring that suitable and safe conditions are available at the agreed location.

Necessary technical, spatial or organisational requirements will be agreed in advance where applicable.

12. Cancellation of Booked Services

If a customer cancels an agreed show, workshop, coaching session or appearance, the cancellation conditions stated in the individual offer or contract apply.

Any expenses already incurred, such as travel bookings, accommodation or preparation costs, may be charged where legally permissible and agreed.

If Marshall Skateboarding / Guenter Mokulys is unable to provide a booked service due to illness, force majeure or other circumstances beyond reasonable control, an alternative date may be agreed.

Further statutory rights remain unaffected.

13. Liability

Marshall Skateboarding / Guenter Mokulys is liable without limitation in cases of intent and gross negligence and in accordance with mandatory statutory provisions.

For slight negligence, liability is limited to foreseeable damages arising from the breach of essential contractual obligations, to the extent permitted by law.

Liability for injury to life, body or health remains unaffected.

14. Skateboarding Risks

Skateboarding is a sporting activity that involves an inherent risk of injury.

Participants in workshops, coaching sessions and other skateboard activities are responsible for assessing their own physical abilities.

The use of appropriate protective equipment, such as helmets and pads, is strongly recommended.

For minors, participation may require the consent of a parent or legal guardian.

Mandatory statutory liability provisions remain unaffected.

15. Copyright

Texts, photographs, graphics, videos, books, teaching materials, skateboard designs and other content created by Guenter Mokulys or Marshall Skateboarding are protected by copyright.

Reproduction, distribution, publication or commercial use requires prior written permission unless permitted by law.

16. Data Protection

Personal data is processed in accordance with the applicable data protection laws and the privacy policy published on this website.

17. Online Dispute Resolution

Where legally required, information regarding consumer dispute resolution will be provided in accordance with current German and European regulations.

Marshall Skateboarding is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.

18. Governing Law

The law of the Federal Republic of Germany applies.

For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable in their country of residence.

19. Severability

If individual provisions of these Terms and Conditions are or become invalid, the validity of the remaining provisions shall remain unaffected.

The applicable statutory provisions shall replace any invalid provision.
